The New Hampshire child welfare system is being sued by a group of older youth in foster care who have a mental health impairment and have been placed in or are at risk of placement in congregate care. The complaint was filed in January 2021, and on September 9, 2021, a federal district court denied the state’s motion to dismiss the complaint. The plaintiffs will be permitted to pursue five of the six claims they raised.
