U.S. Department Of Labor Withdraws ‘Independent Contractor Rule’
On May 6, 2021, the federal Department of Labor (DOL) withdrew a final rule published January 7, 2021, that changed the application of the factors used in the test to determine who is an “independent contractor.” The rule, originally slated to go into effect on March 8, 2021, would have made it easier for employers to classify workers as independent contractors under the Fair Labor Standards Act (FLSA). However, at the change of the presidential administration, the DOL under President Biden extended the effective date to May 7, 2021, then withdrew it before it became effective.
