The Virginia Department of Education (VDOE) is increasing its oversight of local school district special education programs in response to receiving a negative differentiated and support review by the U.S. Department of Education’s Office of Special Education Programs (OSEP). On September 21, 2020, VDOE informed local schools that they will be cited for noncompliance with the Individuals with Disabilities Education Act (IDEA) when VDOE receives reliable information that identifies a problem, either through formal or informal means. VDOE then will require the local school division to create a corrective action plan and show improvement within a year.
