Walmart Sues Federal Government Seeking Clarity About Responsibility For Refusing Opioid Prescriptions
On October 22, 2020, Walmart sued the federal Department of Justice and the Drug Enforcement Administration (DEA) seeking clarity about the roles and responsibilities of pharmacists and pharmacies under the Controlled Substances Act (CSA). The company said that the DOJ is threatening to sue Walmart because the DOJ believes that Walmart pharmacists should have refused to fill otherwise valid opioid prescriptions that were written by physicians approved by the DEA to prescribe opioids.
